Criminal charges filed against Ubial over ‘malicious statements’

ILOILO CITY –– Ex–Health Secretary Paulyn Jean Rosell Ubial and three others will be facing libel charges here over the Dengvaxia row.

Charged in individual complaints were Ubial and former Health Usec. Teodoro Herbosa, Ubial consultant Francisco Cruz, and physician Antonio Leachon.

The criminal complaint was filed by former Health Secretary Janette Loreto Garin before the Iloilo Provincial Prosecutor’s Office under Republic Act 10175 or the Cybercrime Prevention Act.

‘This complaint was filed because I felt so maligned and dishonored by the malicious statements of the persons concerned.  Their public statements were totally malicious, imputing upon me a crime which has caused dishonour, discredit, and contempt upon my person not only as former Secretary of Health but as a former Representative in Congress’ Garin said.

Garin said that Herbosa’s media statements were made with bad intentions and unjustifiable motives, purposely to malign, dishonor, discredit, insult and assassinate her character and good reputation to the public as well as to her constituents.

Cruz on the other hand, face Libel charge with Garin saying his media pronouncements were malicious and damaging statements and likewise offensive to her person.  Garin was referring to Cruz’ allegations of “Mafia” at the DOH with her as among the alleged involved.

‘This statement is not only malicious but untrue. To call me and other DOH officials as belonging to a “Mafia” is purely malicious statement without any basis,’ Garin said in her Complaint-Affidavit went.  “This presupposes that there is a secret organized criminal group or association inside the DOH who are involved in plundering public funds”, she added.

‘Dr. Cruz should present a single evidence, documents or testimony of witnesses to prove these serious allegations against me and other DOH officials and by calling us accused, which we have not been charged for any criminal proceeding’, Garin added.  The charges filed are the second round of complaints following the January 26th filing also of Garin against Cruz.

Leachon for his part faces Libel charge and violation of RA 10175 not only for media interviews granted but in social media posts over his personal Twitter account.

Secretary Garin said the case should be brought to a court where all evidences will be accepted and all voices heard. She said that this case will remove the discussions on air and stop the hysteria and panic which are detrimental to the public.

Ubial was also named respondent in a Libel case and violation of Cybercrime Law earlier filed by Representative Oscar “Richard” Garin.
